Mr. Bryan Archer -2- August 1, 1991 <br />I also inquired of the Office of Surface Mining Reclamation and Enforcement <br />Albuquerque Field Office on how a revision of this type would fare during <br />their review. From their standpoint a revision of this type constitutes a <br />change in post-mining land use. This proposed land use change would need to <br />be supported with documentation demonstrating both an immediate interest and <br />demand for use of the loadout facility as well as a sustained, long term <br />interest and demand. It is my belief that this type of demonstration would be <br />similar to that required by the county as discussed in preceding paragraphs. <br />The loadout constitutes an industrial land use. The areas immediately <br />adjacent to the loadout are classified as rangeland or pastureland. Prior to <br />construction of the loadout, the lands upon which the loadout is currently <br />situated would have been either rangeland or pastureland. Therefore retention <br />of the loadout must be preceded by approval of an alternative land use, in <br />accordance with Rule 1.04(71). Demonstrations necessary for approval of an <br />alternate land use are outlined in Rule 4.16.3.
