Banta, <br />August 1, 1991 Division Direttor <br />Mr. Bryan Archer <br />Sun Coal Co. <br />10200 W. .44th Avenue <br />Wheat Ridge, CO 60033 <br />Re: Meadows No. 1 Mine, File No. C-81-029, General Correspondence <br />Dear Mr. Archer: <br />Several weeks ago you along with your counsel, Mr. Richard Casson, inquired of <br />the possibility of successfully revising your permit in such a manner that <br />would then allow you to turn over the loadout to the landowner, Mr. John Eilts, <br />and receive complete bond release from the Division. This action would in <br />affect end the Mined Land Reclamation Division permit at the Meadows No. 1 <br />Mine. <br />I have approached this question from two perspectives, 1) the loadout and <br />2) the reclaimed pit. I will therefore respond to you from these two <br />perspectives. <br />The loadout, which includes the rail tipple, conveyors, stacking tube, <br />coal crusher, truck dump station etc. ... is currently discussed as <br />temporary in nature in the mining and reclamation application and <br />permit. The plan would therefore need to be revised to reflect the <br />permanent nature of these structures. During evaluation of the proposal <br />to make these permanent structures we would solicit comment and <br />concurrence from the Routt County Planning Office. Ms. Karen Fox of that <br />office has indicated to me during telephone conversations, that they <br />would be willing to give their approval for this change provided the <br />following three conditions were met: <br />- the landowner had applied for a <br />within approximately one month <br />submittal, and such special use <br />received. <br />special use permit from the county <br />of Sun Coal's revision application <br />permit had been successfully <br />Such application for special use would indicate a plan for putting <br />the loadout to use within a very short time and indicate a <br />sustained tong term demand for use of the facility. My <br />understanding of our conversations is that the county is interested <br />in seeing names and commitments from actual parties interested in <br />using the loadout rather than hypothetical projections. <br />The landowner provides a bond to the county to be reflective of and <br />could cover reclamation costs. <br />
