Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve, with conditions, an <br />application for a permit revision (Permit Revision No. 2) to a valid existing permit. This decision is <br />based on a finding that the operations will comply with all requirements of the Colorado State <br />Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., <br />and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made <br />within thirty (30) days of the first publication of the issuance of this proposed decision, then this <br />decision becomes final. The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. A summary of previous stipulations is provided <br />below. All previous stipulations have been terminated or complied with. One new stipulation <br />(Stipulation 18) has been added with Permit Revision No. 2. <br />Stipulations to Permit: <br />STIPULATION NO. 1 <br />PRIOR TO INITIATING MINE RELATED DISTURBANCE AT THE YOAST MINE, SENECA <br />COAL COMPANY MUST OBTAIN THE FOLLOWING PERMITS AND SUBMIT THEM TO <br />THE DIVISION: <br />NPDES PERMIT- PERMIT REQUIRED PRIOR TO CONSTRUCTION OF ALL <br />SEDIMENT PONDS AT THE YOAST MINE. <br />STORM WATER DISCHARGE PERMIT- PERMIT REQUIRED PRIOR TO <br />CONSTRUCTION OF THE HAUL ROAD AND ALL MINING ACTIVITY. <br />3. WATER RIGHTS AND AUGMENTATION APPROVAL- DOCUMENTATION OF <br />APPROVAL OF WATER RIGHTS AND AUGMENTATION PLAN FROM <br />DISTRICT COURT PRIOR TO CONSTRUCTION OF ALL SEDIMENT PONDS <br />AND WATER USE FOR MINING ACTIVITIES. <br />4. ROUTT COUNTY SPECIAL USE PERMIT- PERMIT REQUIRED PRIOR TO <br />CONSTRUCTION OF HAUL ROAD, IMPACTS TO COUNTY ROADS AND ALL <br />MINING RELATED ACTIVITIES. <br />5. AIR QUALITY PERMIT- PERMIT REQUIRED PRIOR TO CONSTRUCTION OF <br />HAUL ROAD AND MINING ACTIVITIES. IF AIR PERMIT IS NOT REQUIRED <br />FOR HAUL ROAD CONSTRUCTION, SENECA COAL COMPANY MUST <br />SUBMIT DOCUMENTATION OF THIS FACT. <br />6. FEDERAL AND STATE EXPLOSIVES PERMITS- PRIOR TO CONDUCTING <br />ANY BLASTING ACTIVITIES. <br />Yoast Mine 7 February 28, 2006 <br />
