Finally the Division received a response from the United Slates Fish & Wildlife Service <br />(USF&WS) in a letter dated August 17, 2000 and received at the Division on August 21, 2000, <br />stating that no specific actions were required for this revision. <br />The Division received a letter on July 11, 2000, dated July 10, 2000, in which the Office of <br />Surface Mining (OSM) determined [hat the approval of TR-16 would make Bowie No. 2 a <br />federal mine and, therefore, a federal mine plan action was required. This mine plan action <br />determination would follow the Division's proposed decision on TR-16. <br />The Division's adequacy review letter was sent on July 21, 2000. BRL submitted its adequacy <br />review responses in a submittal dated July 24, 2000 and received at the Division on July 26, <br />2000. The Division sent a second adequacy review letter on August 11, 2000, in which the <br />Division summarized the adequacy review process. All of the issues had been resolved except <br />for the final BLM letter concerning the water replacement federal stipulation and [he submission <br />of proof of the issuance of the Iron Point Tract Federal Coal Lease. <br />Due to a delay in the issuance of the Iron Point Tract Federal Coal Lease, the decision due date <br />was extended to September 29, 2000. <br />The Iron Point Tract Federal Coal Lease COC 61209 was issued on September 6, 2000, with an <br />effective date of September 1, 2000. With all of the Division's adequacy questions resolved, the <br />proposed decision was made on September 11, 2000. <br />Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve Technical Revision No. 16 <br />for the Bowie No. 2 Mine. This decision is based on a finding that the operations will comply <br />with all requirements of the Colorado State Program, as found in the Colorado Surface Mining <br />Reclamation Act, C.R.S. 34-33-101 et. sey., and the Regulations promulgated pursuant to the <br />Act. Bowie Resources Limited has a valid, existing permit to conduct coal mining operations at <br />the Bowie No. 2 Mine.
