Introduction <br />This document is the proposed decision findings document for Technical Revision No. 16, <br />prepared by the Colorado Division of Minerals and Geology (Division) for the Bowie No. 2 <br />Mine. Technical Revision No. 16 proposes an incidental boundary change to accommodate a <br />change in the mine plan. The mine plan change would allow development mining in the D4 <br />headgate and extend the North mains and the bleeder system to the north. The coal to be mined is <br />federal, part of the Iron Point Tract Federal Coal Lease. The incidental boundary change would <br />add 299 acres to the permit boundary, 169 acres being private surface and 130 acres being <br />federal surface. <br />Ordinarily, a findings document would not be prepared for the proposed decision of a technical <br />revision. However, approval of Technical Revision No. 16 would make [he Bowie No. 2 Mine a <br />federal mine, requiring a federal mine plan action with secretarial approval. Because of this <br />importance, this findings document has been written specifically for this technical revision. <br />The Review Process <br />The initial Technical Revision No. 16 (TR-16) submittal, dated June 8, 2000, was presented by <br />Bowie Resources Limited (BRL) and received at the Division on June 12, 2000. A modification <br />to the public notice was in order so BRL submitted a revised public notice on June l9, 2000. <br />With this additional information, TR-l6 was called complete on June 19, 2000. The Division <br />sent out completeness letters on June 21, 2000 and the public notice of completeness was <br />published in the Deltn County Independent on that same date. <br />The Division received comments concerning TR-16 from various government agencies, although <br />no comments were received from the general public. The Colorado Historical Society, in a letter <br />dated June 27, 2000 and received at [he Division on June 30, 2000, determined that there would <br />not be any cultural resource concerns with this project. <br />The Bureau of Land Management (BLM) sent an adequacy letter, dated July 6, 2000 and <br />received a[ the Division on July ]0, 2000. In their letter, BLM stated that BLM stipulations that <br />were attached to the Iron Point Tract Federal Coal Lease, notably the stipulation involving the <br />water replacement plan, needed to be addressed before BRL was issued the Iron Point Tract <br />Federal Coal Lease. In discussions with the Division, BLM stated [ha[ they would send a final <br />adequacy response letter to the Division concerning TR-l6 and the BLM water replacement <br />federal stipulation. This letter was received on September 7, 2000 and stated that BLM concurs <br />with the TR-16 submittal. <br />The United States Forest Service (USFS), in a telephone conversation on July 17, 2000, stated <br />that the agency had no comments on TR-16 since no USFS lands were involved. <br />
