-7- <br />17. Stipulation: THE DESIGNS AND LOCATIONS OF ALL MONITOR WELLS SHALL BE PROVIDED <br />TO TXE DIVISION WITHIN 30 DAYS OF THE PERMIT ISSUING. EACH MONITORING WELL <br />INSTALLED SUBSEQUENT TO THE PERMIT ISSUING SHALL BE DESIGNED SUCH THAT EACH <br />AQUIFER CAN BE MEASURED AND SAMPLED WITHIN THE BORE HOLE. THE APPLICANT SHALL <br />1 SUBMIT TO TXE DIVISION A COMPLETION REPORT FOR EACH NEW WELL WHEN SUBMITTING <br />IUn'rC~, ~~/,y~p}I THE FIRST QUARTER' S DATA COLLECTED FOR EACH WELL. <br />MLRD Findings Lbcument: Stipulation No. 16, p. 16 <br />OSM Findings Document: Stipulation No. 19, p. 7 as follows: <br />19. The designs and locations of all monitor wells shall be provided to the <br />regulatory authority within 30 days of the permit issuance. Each monitor- <br />ing well installed subsequently shall be designed to sample one geologic <br />unit. The applicant shall submit to the regulatory authority a completion <br />report for each new well. A11 monitor wells shall be monitored for water <br />levels monthly and water quality on a quarterly basis for the duration of <br />the 1-year base-line data collection period. All data shall be submitted <br />to the regulatory authority quarterly. <br />NOTE: The second part of OSM Stipulation 19 is the same as MLRD Stipulation No. 21 <br />of this memo. <br />OSM TEA: Stipulation No. 11 (listed as No. 2 under Section 817.52(a)), p.34 <br />as follows: <br />11. Stipulation 2: The designs and locations of all monitor wells shall be <br />provided to the regulatory authority. Each well must be designed to <br />sample only a single geologic unit and the interval sampled by each well <br />should be specified. <br />18. Stipulation: WITHIN 3 MONTHS OF DIVISION APPROVAL OF THE APPLICATION, ARCO COAL <br />SHALL JUSTIFY THE USE OF THE PROPOSED SHRUB DENSITY SUCCESS STANDARD OF 1000 <br />STEMS/ACRE, BY PROVIDING THE FINDINGS OF THE TECHNICAL REFERENCES/SOURCES USED <br />TO ESTABLISH THIS STANDARD. ON ANY FEDERAL LANDS WITHIN THE BOUNDARIES OF A NATIONAL FOREST: <br />4: NOT WITHIN 100 FEET, MEASURED HORIZONTALLY, OF THE OUTSIDE RIGHT-OF-WAY <br />~ ~ LINE OF A PUBLIC ROAD; <br />-~.'~ 5.
