NO SURFACE DISTURBANCE OTHER <br />TXAN THAT NECESSARY FOR THE PNSTALLATION OF THE DIVERSION DITCH SYSTEM SHALL <br />OCCUR ON THE PROPOSED UPPER TERRACE DRY MEADOW AREAS OF DISTURBANCE PRIOR TO <br />COMPLETEION OF ALL VEGETATION SAMPLSNG REQUIRED HEREIN. TXE VEGETATION <br />CHARACTERISTICS OF TXE REVISED REFERENCE AREA SHALL BE STATISTICALLY COMPARED <br />TO THOSE OF THE CORRESPONDING AFFECTED AREAS USINC THE PROCEDURES DISCUSSED IN <br />THE APPLICATION. A SPECIFIC PLAN SHALL BE DEVELOPED FOR THE DRY MEADOW REFERENCE <br />AREA TXAT WILL ENSURE THE PROPER MANAGEMENT OF THIS AREA THROUGHOUT THE LIFE OF <br />TXE MINE. THE DRY MEADOW MANAGEMENT PLAN SHALL INCLUDE MEASURES TO ENSURE THAT <br />THE VEGETATION TYPE REMAINS ESSENTIALLY UNCHANGED FROM TXE PRIMARILY HERBACEOUS <br />VEGETATION STRUCTURE TXAT EXISTED AT THE TIME OF TXE 1980 REFERENCE AREA BASE- <br />LINE INVENTORY. PRIOR TO COMPLETION OF TXE BASELINE INVENTORY FOR THE DRY <br />MEADOW COMMUNITY, THE PROPOSED DRY MEADOW AFFECTED AREAS SHALL BE MANAGED IN <br />THE SAME WAY AS THE REVISED DRY MEADOW REFERENCE AREA. THE REVISED REFERENCE <br />AREA MAP, ALL DRTR AND ANALYSES, AND THE REFERENCE AREA MANAGEMENT PLAN SHALL <br />BE SUBMITTED FOR APPROVAL TO THE DIVISION BY DECEMBER 1, 1982. <br />NOTE: This stipulation has also been revised by OSM as follows: <br />39. Prior to August Z, 1981, the applicant shall_.select, in consultation with <br />the Colorado MLRD and OSM, appropriate areas to increase the size of the <br />existing dry meadow reference area from 0.8 acres to approximately 2.0 <br />acres. The enlarge dry meadow reference area shall be mapped at a scale <br />of 1" = 100' so as to clearly indicate those areas within the revised <br />reference area that will not be sampled in the future. The revised <br />reference area, as well as the dry meadow areas to be affected, shall be <br />sampled by September 1, 1982, for cover, production and woody plant <br />density using the methods identified in the MRP for the baseline reference <br />area survey. No surface disturbance other than that necessary for <br />construction of the peripheral diversion ditches (as discussed with the <br />applicant) shall occur on the proposed upper terrace dry meadow areas of <br />disturbance prior to completion of all vegetation sampling required here- <br />in. The vegetation characteristics of the revised reference area shall <br />be statistically compared to those of the corresponding affected areas <br />using the procedures discussed in the MRP. A specific plan shall be <br />developed for both the dry meadow and wet mixed shrub reference areas <br />that would ensure the proper management of these areas throughout the life <br />of the mine. The dry meadow management plan shall include measures to <br />insure that the vegetation type remains essentially unchanged from the <br />primarily herbaceous vegetation structure that existed at the time of the <br />1980 reference area baseline inventory. Prior to completion of the baseline <br />inventory for the dry meadow community, the proposed dry meadow affected <br />areas shall be managed in the same way as the revised dry meadow reference <br />area. During the 9th and 10th years of the bond liability period, the <br />revegetated and reference areas sha31 be managed in thesame way. The revised <br />reference area map, all data and analyses, and the reference area management <br />plans shall be submitted for approval to the regulatory authority by December <br />1, 1982. <br />2.
