(Listed as No. 2 under Subsection F of the Cultural Resources Section, p. 218) <br />2) The operator shall ensure that a sample survey for cultural <br />resources is performed on all areas where there is the potential <br />for subsidence. Emphasis should be directed towards the <br />determination of the presence or absence of sites which may <br />be sensitive to the adverse effects of subsidence, e. g., <br />historic and prehistoric structures and/or structural remains, <br />rock shelters, and rock art sites. If such resources are <br />located, further surveys may be necessary. <br />OSM Findings Document: Stipulation No. 45, p. 12 <br />50. (Listed as No. 3 under Subsection F of the Cultural Resources Section, p. 218) <br />3) Should sites which may be sensitive to subsidence be located, <br />the operator will consult with the regulatory authority to <br />determine whether mitigation measures or monitoring activities <br />are necessary to either avoid adverse impacts or to determine <br />whether the site will be impacted by subsidence. <br />OSM Findings Document: Stipulation No. 46, p. 12 <br />The following is a list of stipulations from the Bureau of Land Management, which were <br />included within the OSM findings document only. <br />48. Surface facilities, occupancy, surface disturbance, industrial <br />fires and subsidence will not be permitted in the Eagle or <br />Cooper's Hawk nests buffer zones. Some surface activities may <br />be permissible in the buffer zone at times other than the <br />breeding/rearing season or if the nests are inactive. <br />49. Surface disturbance in the North Fork of the Gunnison River <br />affectin g aquatic habitat may be permitted in the stream habitat <br />with the approval of the Bureau of Land Management after <br />consultation with the Colorado Division of Wildlife. Surface <br />disturbance includes surface facilities, subsidence channel <br />modifications, and reduction of water quality to not less <br />than receiving stream standards. <br />50. Surface disturbance within a 1/8-mile riparian buffer zone <br />may be permitted with the approval of the Bureau of Land <br />Management after consultation with the U.S. Fish and Wildlife <br />Service. <br />
