-16- <br />The following is a List of additional OSM stipulations that were not included within <br />the MLRD permit or findings documents. Please note that stipulations 20, 16, 16(a), <br />31, 33, 39, 40, 41 and 45 are included with the OSM TEA Document only. <br />19. (p. 56 TEA) Stipulation: Applicant shall notify the regulatory agency <br />prior to commencing work in the potential Zandslide area. <br />A qualified, registered professional engineer shall certify <br />by letter that the dewatering system is operational and that <br />construction will not increase the potential for landslides <br />in the identified hazard area. <br />OSM Findings Document: Stipulation No. 25, p. 8 <br />20. (P. 62 TER) Stipulation: The applicant should provide a detailed descrip- <br />tion of the receiving channel and the outlet of Diversion Ditch 1. <br />26. (p. 119 TEA) 817.106 - Regrading or stabilizing rills and gullies <br />The control and elimination of rills or gullies in reseeded <br />areas is not addressed in the mine plan. <br />Stipulation: The application should commit to compliance with <br />this rule. <br />26(a). TListed as No. I under Section 8I7.101(F)(1), p. 114) <br />Stipulation: The applicant should submit plans of procedures <br />to remove the effects and recover the reclamation stability <br />caused by rills or gullies more than 9 inches deep upon <br />reclaimed areas. <br />31. (p.159 TEA) 2.05.6(5)(b)(i)(C) Stipulation: Expand the description of <br />effects upon renewable resources to include food, fiber and <br />soils, ground water. <br />33. (p. 189 TEA) Stipulation: Prior to actual construction of bin walls for <br />supports of road cuts, the applicant shall demonstrate either <br />that a static factor of safety of at least 1.5 is achievable <br />for the supported cut slope or that a safety factor of less <br />than 1.5 does not pose a threat of significant environmental <br />harm or harm to the public health and safety. <br />39. (Listed as No. 1 under Section 817.81, Coal Processing Wastes, p. 196) <br />1) The applicant must perform sufficient portions of its <br />commitment to ensure compliance in the event predictions of <br />design must be changed. <br />40. (Listed as No. 2 under Section 817.89(a), p. I96) <br />2) The applicant must state how petrochemical wastes will be <br />disposed of and what procedures will be used to prevent <br />Ieachate contamination of ground and surface waters if land- <br />fills are used. <br />
