Production data for the alkali sagebrush community within the affected area <br />and reference area was submitted to satisfy the requirements of Stipulation <br />17, Previous data available in the permit document defined production and <br />cover for the big sagebrush community. Reference area cover and <br />production-weighted means will be compared to the revegetated means. <br />Revegetation success criteria standards will be based on comparison to <br />reference areas. <br />No proposed or listed threatened or endangered plant species have been <br />identified at the Canadian Strip Mine site. As such, the Division finds that <br />the activities would not affect the continued existence of endangered or <br />threatened species or result in the destruction or adverse modification of <br />their critical habitats (2.07.6(2)(n)). <br />The operation is in compliance with the requirements of this section. <br />XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />Information regarding fish and wildlife is found in Appendix G of Volume II of <br />the original permit application, <br />The permit and adjacent areas are included within areas of highly-ranked <br />wildlife habitat. The major uses of the area by wildlife include antelope <br />fawning, mule deer winter range, mule deer migration route, and sage grouse <br />mating, nesting and winter habitat. The full use of the area by wildlife will <br />resume upon reclamation of the disturbed area within the permit term. <br />Fish and wildlife information provided by Wyoming Fuel Company haS not <br />identified any threatened or endangered species or any critical habitat of the <br />threatened or endangered species in the permit or adjacent areas. As there <br />are no adverse impacts expected to occur due to the proposed operations at the <br />Canadian Strip Mine site, the Division makes the finding that the proposed <br />mining activities at the Canadian Strip Mine "would not affect the continued <br />existence of endangered or threatened species or result in the destruction of <br />adverse modification of their critical habitats" (2, 07.6(2)(n)). <br />The proposed operation is in compliance with the requirements of this section. <br />XIY, Prime Farmland - Rules 2.04.12, 2.06.6 and 4.25 <br />Information regarding Prime Farmland is found in Appendix I of Volume II of <br />the original permit application. <br />The Division has made a negative determination for the presence of prime <br />farmland within the proposed permit area. This decision is based on a letter <br />of August 6, 1979, from Kenn Lutz, District Conservationist of the Soil <br />Conservation Service, stating that there are no prime farmland mapping units <br />within the proposed permit area. <br />-.
