Long
Division D'neclor
1. Develops a new class of mining operation. Such operators would
potentially be required to meet more stringent permitting re~~uirements
and to develop an environmental protection plan. This class ~leale
exclusively with metal mining operations that: (1) use toxic or
hazardous materials for their operations; (2) produce or disturb acid or
toxic forming materials; (3) generate acid mine drainage; or (4) have
high potential to release contaminants to the environment.
2. Allows the Hined Land Reclamation Board to impose compliance with new
environmental or public health requirements. This applies to this new
class of operation only after a specific finding by the boar3 that such
requirements would be necessary to protect the public and/or
environment.
3. Allows the board to extend by 60 days the review period for complex
operations. Current statutes require automatic permit approval within
120 days after application.
4. Allows the board to deny a permit if there are serious or unresolved
public health or environmental concerns.
5. Requires certification for these types of operations at critical
construction phases to will enable identification and resolution of
problems while they are still manageable.
6. Strengthens the state's bonding authority by: (1) removing certain types
of problematic bonding vehicles (such as real estate); (2) allowing the
board discretion to accept or reject letters of credit; (3) adding a
five-year reclamation liability period for these types of operations
while still allowing incremental bond releases as work is completed; (4)
allowing the state to recoup personnel costa related to reclamation in
the event of forfeitures.
7. Creates a mining impact mitigation fund for immediate remediation of
health or environmental concerns. (From donations or other sources
determined by the legislature.)
8. Provides expedited process for et ate intervention in emergency
situations that involve public health and safety or the environment.
9. Increases permit and annual fees for these operations to cover the real
coat of permitting and inspecting these facilities.
10. Requires an environmental protection plan for designated operations that
include greater environmental protection requirements while the mine is
operating.
11. Special Operation permits (111) are changed from 10 acres to 30 acres.
LP/C:\WP51\HINNEW
