Long <br />Division D'neclor <br />1. Develops a new class of mining operation. Such operators would <br />potentially be required to meet more stringent permitting re~~uirements <br />and to develop an environmental protection plan. This class ~leale <br />exclusively with metal mining operations that: (1) use toxic or <br />hazardous materials for their operations; (2) produce or disturb acid or <br />toxic forming materials; (3) generate acid mine drainage; or (4) have <br />high potential to release contaminants to the environment. <br />2. Allows the Hined Land Reclamation Board to impose compliance with new <br />environmental or public health requirements. This applies to this new <br />class of operation only after a specific finding by the boar3 that such <br />requirements would be necessary to protect the public and/or <br />environment. <br />3. Allows the board to extend by 60 days the review period for complex <br />operations. Current statutes require automatic permit approval within <br />120 days after application. <br />4. Allows the board to deny a permit if there are serious or unresolved <br />public health or environmental concerns. <br />5. Requires certification for these types of operations at critical <br />construction phases to will enable identification and resolution of <br />problems while they are still manageable. <br />6. Strengthens the state's bonding authority by: (1) removing certain types <br />of problematic bonding vehicles (such as real estate); (2) allowing the <br />board discretion to accept or reject letters of credit; (3) adding a <br />five-year reclamation liability period for these types of operations <br />while still allowing incremental bond releases as work is completed; (4) <br />allowing the state to recoup personnel costa related to reclamation in <br />the event of forfeitures. <br />7. Creates a mining impact mitigation fund for immediate remediation of <br />health or environmental concerns. (From donations or other sources <br />determined by the legislature.) <br />8. Provides expedited process for et ate intervention in emergency <br />situations that involve public health and safety or the environment. <br />9. Increases permit and annual fees for these operations to cover the real <br />coat of permitting and inspecting these facilities. <br />10. Requires an environmental protection plan for designated operations that <br />include greater environmental protection requirements while the mine is <br />operating. <br />11.
