Box 653-Caribou <br />Nederland, CO 80466-0653 <br />RE: Your letter of October 20, 1993, Boulder Mill. <br />Dear Mr. Hendricks: <br />OF'~~(O <br />tide <br />M <br />~,g~. <br />Roy Romer <br />Governor <br />Michael B Lonb <br />Division Direuo~ <br />The Division of Minerals and Geology has reviewed your letter <br />requesting what would be required to permit the Boulder Mill <br />facility and what size reclamation bond would have to bey posted. <br />It is hard to say what size reclamation bond would be required <br />since a detailed operation and reclamation plan is necessary before <br />the Division can evaluate, on a task by task basis, the reclamation <br />required and thus the size of the bond. I can be somewhat more <br />definitive about what would be required to permit this oF~eration. <br />Administratively, the area would have to be permitted ais a new <br />operation under the new provisions of the Mined Land Reclamation <br />Act pertaining to designated mining operations. I have enclosed a <br />copy of the recently changed Act and a summary sheet of the recent <br />changes. Please especially note the environmental protection plan <br />requirements. <br />I will list some of the things the Division takes in to account <br />when permitting sites such as this: <br />Location of the site and its geologic and hydrologic <br />conditions. This would include detailed analyses of any <br />formerly deposited tailings material(s) that wr~uld be <br />disturbed by the proposed operation. This would also include <br />detailed baseline analyses. <br />Nature of the ore being shipped to the site. we understand <br />that the ore has a more complicated mineralogy than indicated <br />in your letter. We would anticipate finding other base metal <br />sulfides upon detailed analysis. At a minimum, the Division <br />would require 3rd party sampling of the ore for use in a <br />mineralogical analysis.
