difficult as the level of t~iver dropped. In 1984 Animas A~regates straic3htened the
river out upstream of this eastern channel diversion and directly into thf~lr pit. This
action dried up this eastern channel totally. As a result we can not utilize our water as it
had been historicaily done for over 100 years. I, as well as my neighbor's want the
water back in the ditch where it rightfully belongs and feel that Animas Aggregates
should be required to see to it that this happens.
Further, their activity has diverted the full flow of the Animas River from its natural
channel and directly into their pit, totally drying up the original main channel. AI! the
dozer activity in this area has created the appearance of a "war zone" n the river
bottom.
feel that this is all irresponsible and has damaged my and my neighbors' property
rights. I would like to have these issues considered in the review of allowing further
aggregate activity in this area and I request that remedial action be required to mend
the damage that has been done. Our water rights far supersede any aggregate mining
activity in the area.
A shall include an aerial photo of the area in question which includes some drafting by
Animas Aggregates of their river channel alteration which dried up the arm ~~f the river
supplying the Wallace Ditch. I shall also enclose an aerial view of the Animas River
prior to Animas Aggregates activities.
Please call me if you have any questions or if you feel that more specifics me.y help
Thank you for your attention.
Sincerely,
Geof Schlittgen
