Attachment 12-3 includes a narrative description and location map (Figwe 49-1) regarding Sage Creek and <br />Wolf Creek coal seam, overbwden, and underbwden ground water monitoring wells. The wells were damaged <br />by apparent ground movement m the spring of 2003, and will need to be replaced. Please Amend <br />Attachment 12-3 to address the current status of the subject wells, and include a commitment to install <br />appropriate replacement monitoring wells in 2004. <br />Rnle 7 nS'i(3~(r) Roadc <br />14. Narrative on Tab 13, page 11 references As-Built designs for various haul roads. The narrative needs to be <br />updated to reference the Haul Road J As-Built. Also, Haul Road K construction has been completed, but the <br />required construction certification has not yet been submitted. The required certification and As-Built for Road <br />K will need to be provided. Please submit required Haul Road K construction certification and As-Built <br />design, and amend narrative as appropriate to reference Haul Road Jand K As-Built designs. <br />l5. There is out-dated regulatory language on page 16 indicating that haul roads not within the distwbed area will <br />be certified "if requved by the DMG for good cause shown". Please delete the quoted clause, to correspond <br />to the current haul road certification requirement of 4.03.1(1)(d)(i). <br />16. Narrative at the bottom of page 27a of Tab 13, regarding haul roads to be retained as permanent access roads, <br />does not "flow" to page 28. Itemized provisions "c" through "e" seem to be missing. Please amend the <br />referenced pages as appropriate. <br />17. Access Road narrative beginning on page 28 of Tab 13 is outdated in several respects. First, the narrative <br />should be amended to address the proposed oil well access road. Second, current Rules 4.03.2(4)(1) and (ii) <br />require certification (or statement in lieu of certification in certain cvcumstances) for access roads not within <br />[he disturbed area. Third, embanlanent slope minimum safety factor of 1.25 does not comply with current <br />4.03.2(3)(e)(ix) requirement of l3. Finally, the citation at the end of the last full paragraph on page 31 does <br />not correspond to the rule section as currently organized. The appropriate citation would appear to be <br />4.03.2(3)(e)(iv). Construction certification and As-Built design for recently completed Sediment Pond 016A has not yet been <br />submitted. Construction certification and As-Built design for Sediment Pond 006 Phase V design <br />(incorporating recently installed primary spillway extension) has not yet been submitted. Initial annual <br />impoundment certifications for Sediment Ponds 005, 006, 009, 015, 016, and 017 have not yet been submitted. <br />Please submit the referenced construction certifications/As-built designs and annual impoundment <br />certifications, as necessary to comply with applicable requirements of 4.05.9(14) and (15). <br />19. In the November 2003 inspection report, the need was identified for a new collection ditch to diver[ disturbed <br />area runoff from the active pit, spoil, and pre-strip areas away from the native drainage channeUriparian zone of <br />Hubberson Gulch fork above Pond ] 7. The operator indicated that a revision would be submitted to address <br />construction of such ditch along the existing light use road above Pond 17. Disturbed drainage would be <br />routed along the ditch directly into Pond 17, to protect the native channel segment from excessive erosion or <br />sediment deposition. Please submit appropriate design plans for the referenced collection ditch. <br />20. Text on page 4 of Tab 13 states that the sediment storage capacity of each sedimentation pond or imoandment <br />will be monitored on an annual basis to ensure at least one year of sediment storage beneath the principal <br />spillway. The sediment storage capacity is critical for sedimentation ponds and other sediment retention <br />13 <br />
