t '~ -:• <br />Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve with seven <br />stipulations an application fora permit to conduct underground coal mining <br />operations at the La Plata No. 1 Mine. The mine is located on private lands <br />in La Plata County, Colorado. The legal description of the permit area is the <br />SW 1/4 NW 1/4 and a portion of the NW 1/4 SW 1/4 Section 28, and S 1/2 NW 1/4, <br />NE 1/4 NE 1/4 and N 1/2 SE 1/4 of Section 29, T35N, R11W, N.M.P,M. There are <br />192.97 acres within the proposed permit area of which 111 acres will be <br />affected by mine development activities and 7 acres will be disturbed by <br />surface facilities which support the underground development. <br />This approval is based on a finding that the proposed operation will comply <br />with all requirements of the Colorado State Program as found in the Colorado <br />Surface Coal Mining Reclamation Act, C.R,S. as amended, 34-33-101 et sec., and <br />the Regulations promulgated pursuant to the Act. <br />If no requests for a formal hearing are made within thirty (30) days of the <br />issuance of this proposed decision, then this decision becomes final and, upon <br />submittal of an acceptable surety by La Plata Coal Corporation, the permit <br />will issue. Upon permit issuance, the permit application will become a <br />binding part of the permit. <br />-2- <br />
