~ <br /> <br />r I <br /> <br />rr <br />I ~r <br />As discussed in yBur meeting with my staff, preparation of the EIS is <br />dependent upon MLRD's processing of the permit application(s) to the <br />point that the scope of the mining and reclamation plans have been <br />so lidl~r defined, and draft findings including the draft cumulative <br />hydrologic impact assessment (CHIA) are complete. For all three Fruits <br />leases~r the aspects of the mining and reclamation plans that would affect <br />the hydrologic balance must be completed in order to prepare the CHIA <br />documeht which is required prior to permit approval and is necessary for <br />the EIS preparation. American Shield Coal Company's submittal of these <br />design aspects for all leases is a key aspect o£ the timely processing of <br />the applications. Additionally, by better defining the scope of the <br />mining and reclamation operations for all leases, the requirements to <br />discuss alternative design methodologies in the EIS is reduced and the <br />EIS preparation process simplified and shortened. <br />From t~e time of your meeting with my staff in April, OSMRE has renexed <br />processing efforts on the permit application. I appreciate your concern <br />with the timing of the Fruita project, and we xill make all reasonable <br />efforts to meet your time schedule. However, the Fruita project must be <br />scheduled in with OSMRE's existing work load. Considering the time <br />elapsed since this project was active, much of the potential advantages <br />in time savings resulting from previous work completed on the project may <br />be los~.
