Massey <br />Hultin d Speanstra <br />The Flower/Voile House <br />1610 Emerson Street <br />Denver, Colorado 80218 <br />Dear Mr. Massey: <br />I am writing in response to your letter of April 18, 1986, regarding the <br />Fruits Project. Ae you knox, the Office of Surface Mining Reclamation <br />and Enforcement (OSMRE) is responsible for preparation of the decision <br />document for a decision on the Fruits mining plan and ensuring the <br />decision is made in compliance rith the National Environmental Policy Act <br />(NEPA~. Upon notification that the Fruits Project is being reactivated, <br />OSMRE began coordination efforts to resume processing of the application. <br />In March and October of 1984, OSMRE provided initial review comments to <br />Colorado Mined Land Reclamation Division (NERD) for the three Fruits <br />applications. As stated in your letter, Dorchester submitted a response <br />to the environmental baseline portion of the deficiencies identified in <br />the permit application in mid 1985 and processing of the applications <br />ceased shortly thereafter. In the interim, changes have occurred in <br />personnel assignments, as xell ae policies and procedures for processing <br />permit applications. These factors offset many of the potential <br />time-saving advantages to the Fruits project resulting from previous work <br />completed oa the project. <br />Pcrw~~~ 'L.er~eu: <br />After my staff met with you in April regarding reactivating the Fruits <br />project, OSMRE resumed activities in processing the permit application. <br />We have been in contact xith Colorado MLRD and the Colorado Joint Review <br />Process (CJBP) to discuss schedules and future xork for permitting and <br />EIS preparation.- ~Y staff is currently reviewing the information <br />previously submitted by Dorchester and will provide MLRD xith any <br />comments. Ne have contacted the Bureau of Land Management (BEM) <br />regarding reaered efforts in preparation of the EIS. In a meeting with <br />Mr. Norris of the CJRP, xe agreed that a CJRP meeting should be held once <br />the agencies involved have reactivated the project and are prepared for a <br />meeting.
