G. Written Results of Inspections and Evaluations <br />• Written results of the inspection were placed on file for public inspection at the offices of the <br />Division in compliance with Rule 3.03.2(2). This summary of evaluations (Findings of Compliance) <br />will also be on file for public inspection at the offices of the Division in compliance with Rule <br />3.03.2(2), Results of inspections and monitoring were considered by the Division in this Findings <br />of Compliance pursuant to Rules 4.05.13 and 5.02. Information on who attended, who they <br />represented, topics of concern, and other coordination is addressed under Paragraphs III.C and <br />III.D. <br />VI. PROPOSED DECISION <br />Based on this Findings of Compliance, the Division proposes to approve the Colowyo Coal <br />Company L.P.'s 1997 Application for release of liability for Partial Phase I and placement of topsoil <br />(partial Phase II) reclamation work for the applicable areas of the Colowyo Coal Mine (Permit C- <br />81-019). All requirements of the Rules and Act have been successfully completed. <br />A. Rule 3.03.2(5)(a) Decision and Written Notification <br />The Division shall provide written notification to the permittee, the surety, any person with an interest <br />in collateral who has previously requested notification and any other interested parries of its proposed <br />decision to release or not release all or part of the performance bond, together with written reasons for <br />• such proposed decision, recommended corrective actions necessary to secure release, and of their right <br />to request a public hearing as described in 3.03.2(6} within sixty (60} days after the date of completion <br />of the inspection and evaluation required in Rule 3.03.2(2). Funkier, the Division shall publish written <br />notice of its proposed decision once a week for two consecutive weeks in a newspaper of general <br />circulation in the locality of the surface coal mining operation and shall immediately provide written <br />notification of its proposed decision by certified mail to the board of county commissioners of the county <br />in which the surface coal mining operation is located. The Division shall publish its proposed decision <br />in its monthly mailing under 1.03.2(2). <br />• 2 8 April 27, 1998 <br />
