10. Rule 4.15.9 Revegetation Criteria, Cropland <br />If cropland, the vegetation must produce at 90% of nonmined or reference areas. <br />No element of the Application pertains to this Rule. <br />11. Rule 4.20.3(1) Surface Owner Protection (Subsidence) <br />Each person who conducts underground mining activities shall adopt all measures of the subsidence <br />control plan approved by the Division to reduce the likelihood of subsidence, to prevent subsidence from <br />causing material damage or reducing the value or reasonably foreseeable use of surface lands, and to <br />mitigate the effects of any such damage or reduction which may occur. <br />The Division may release the bond or reclamation liability for surface areas overlying underground <br />workings only after all mining in the area is completed and the major subsidence effects, if any, <br />have been manifested. Division policy is that the liability period is a minimum of three years after <br />mining for areas of extraction. Resolution of Comments and Other Reclamation Requirements <br />No comments or other reclamation requirements were developed during the review and evaluation <br />of this Application that required resolution. <br />F. Summary and Conclusions <br />Based upon a review of the mine Permit, the applicant's bond release Application as amended, and <br />site inspections, the Division finds that Colowyo Coal Company L.P. has successfully completed the <br />surface coal mining reclamation operations in accordance with the approved reclamation plan and <br />met all requirements of the Act and the Rules for the requested partial Phase I and partial topsoil <br />replacement Bond Release. <br />• 27 April 27, 1998 <br />
