2. Rule 3.03.1(3)(b) Suspended Solids, Productivity and Hydrologic Functions <br />No more than sixty (60) percent of the bond shall be released so long as the lands to which the release <br />would be applicable are contributing suspended solids to streamflow or runoff outside the permit area <br />!n excess of premining levels as determined by baseline data or in excess of levels determined on <br />adjacent nonmined areas; until soil productivity for prime farmlands has returned to equivalent levels <br />of yield as nonmined land of the same soil type on the surounding area under equivalent management <br />practices as determined from the soil survey performed under 2.04.12 and 2.06.6 and the success <br />determination methodology of 4.25.5(3)(a); or, on alluvial valley floors, until the essential hydrologic <br />functions and agricultural productivity have been reestablished. <br />No element of the Application pertains to this Rule. <br />3. Rule 3.03.1(3)(c) Maintenance of Permanent Impoundments <br />YVhere a silt dam is to be retained as a permanent impoundment as described in 4.05.6 or 4.05.9, more <br />than sixty (6D) percent of the bond may be released only so long as provisions for sound future <br />maintenance by the pernittee or the landowner have been made with the CDMG. <br />No element of the Application pertains to this Rule. <br />4. Rule 3.03.1(3)(d) Minimum Retention -Remaining Reclamation Work <br />• The Division shall not release any amount under performance bonds applicable to a permit if such <br />release would reduce the total remaining amount under performance bonds to an amount less than that <br />necessary for the Division to complete the approved reclamation plan. <br />The Division retains sufficient bond liability to complete all remaining reclamation work. <br />5. Rule 3.03.1(3)(e) Alternative Postmining Land Use Bond Coverage <br />When the permit includes an alternative postmining land use plan for industrial or commercial, or <br />residential ttse, approved pursuant to Rule 4.16.3, the Division shall require the maintenance of bond <br />coverage throughout the applicable liability period, sufficient for the Division to achieve compliance <br />with the standards for revegetation applicable to the pre-mining land use under 4.15, in the event the <br />alternative postmining land use is not developed in the event of bond forfeiture. <br />No element of the Application pertains to this Rule. <br />25 April 27, 1998 <br />
