<br />The Division has determined the degree of difficulty to complete the reclamation for the areas <br />i subject to this Application, and has included these liabilities in the estimated cost to reclaim all of <br />the mining activities associated with the entire permit (see Exhibit 13, Bond Reclamation Cost <br />Estimate). This estimate, as of Apri127, 1998, is $15,670,521. <br />2. Pollution of Surface Water <br />The Division has considered, among other things, the results of inspections and monitoring <br />conducted pursuant to Rules 4.05 and 5.02, to determine whether pollution of surface water is <br />occurring. In addition, the Division reviewed surface water quantity. The permittee complied with <br />the requirements of Rules 4.05.13(2). Monitoring programs, approved by the Division, were <br />developed and administered. The Division finds that there is no long-term change to water quality <br />in nearby receiving waters. <br />3. Pollution of Ground Water <br />The Division found no indications of pollution of ground water <br />4. Cost of Pollution Abatement <br />The Division finds that there is no impact to surface and subsurface waters that requires abatement, <br />and the probability of any future adverse impacts that would require abatement is low. Thus there <br />• is no cost associated with such abatements. <br />5. Probability of Future Pollution <br />The Division finds that the probability of future adverse impacts to surface and subsurface waters <br />that would require abatement is low. <br />E. Retention of Bond <br />1. Rule 3.03.1(3)(a) Reestablishment of Revegetation <br />When determining the amount of bond to be released, the Board or Division shall retain that amount <br />of bond for the revegetated area which would be sufficient for a third party to cover the cost of <br />reestablishing revegetation at any time during the period specified for permittee responsibility for <br />revegetation described in Rule 3.02.3. <br />The Division retains sufficient funds for a third party to complete all remaining reclamation <br />requirements. <br />24 Apri127, 1998 <br />
