Section II -Revisions to the Permit <br />Subsequent to the proposed decision to approve the permit renewal request, Sun Coal Company has <br />submitted and a Division decision has been made for the following revisions: <br />Technical Revision No. 15, in response to Stipulation No. 13, was received by the Division on July 5, 1994, <br />and deemed complete on July 7, 1994. The revision application proposed clarifications to the facilities <br />area reclamation plan so that all existing structures would permanently remain on site. On September 30, <br />1994 the Division proposed a decision to deny the revision, since Sun Coal Company did not have the <br />required landowner consent to retain certain structures. Sun Coal Company requested a hearing before <br />the Mined Land Reclamation Board (Board) to object to the Division's proposed decision. The Board <br />hearing was held on November 16, 1994, at which the landowner stated his preferences for retention of <br />some structures. The Board reversed, in part, the Division's decision, and produced a list of items which <br />would be allowed to be retained and items which must be removed. <br />Technical Revision No. 16 was received by the Division on July 7, 1994, in response to a notice of violation <br />(NOV C-94-010) which was later vacated. The revision included a demonstration that the Northwest <br />Sediment trap, as constructed, was capable of containing discharge from a 25-year, 24-hour storm. The <br />revision was approved on October 3, 1994. <br />Technical Revision No. 17, which was received by the Division on April 28, 1995 proposed termination <br />of backfill stability monitoring. The revision was approved on June 2, 1995. <br />Technical Revision No. 18, which was received by the Division on August 31, 1995, revised the facilities <br />area reclamation plan to retain all structures on site. Sun Coal Company had obtained the necessary <br />landowner consent, and so the revision was approved on November 20, 1995. <br />Minor Revision No. 7, in response to Stipulation No. 12, was received by the Division on January 12, 1994. <br />The submittal included revised ownership and control information for Sun Coal Company and provided <br />proof of resolution of improvidently issued permits and cessation orders involving Sun Coal Company's <br />parent corporation. The revision was approved on January 21, 1994. <br />Minor Revision No. 8, received April 19, 1994, provided updated ownership and control information for <br />Sun Coal Company. The revision was approved on April 25, 1994. <br />Minor Revision No. 9, in response to Notice of Violation No. C-94-011, was received on June 9, 1994. <br />The revision proposed a reduction in the frequency of rill and gully inspections from monthly to annually, <br />and was approved on July 5, 1994. <br />Minor Revision No. 10, in response to Notice of Violation No. C-94-36, was received on December 1, <br />1994.
