Section 1 -History The Meadows No. 1 Mine is a surface mine which was operated by Sun Coal Company (Sun). Sun mined privately owned coal from the Pinnacle seam until February 1981. Permit No. C-81-029 was issued in August 1983, for reclamation operations only. The mine was backfilled and graded in the Fall of 1983, and was seeded the following Spring. Sun Coal Company received a Phase I bond release for the entire pit area in 1986, and a Phase II release for a portion of the pit area in 1995. The haul road was entirely released from liability in 1988. On January 13, 1993, the Division received an application from Sun Coal Company to renew the valid, existing permit for surface mining operations at the Meadows No. 1 Mine. The application was approved with conditions on June 2, 1993. The five year permit term was renewed effective August 9, 1993, and will expire on August 9, 1998. Enforcement Actions Five enforcement actions were taken since the permit was renewed, all of which were notices of violation. Two of the notices were subsequently vacated. A description of the notices which were upheld and their status follows: Notice of Violation C-94-011 Issued May 25, 1994. The nature of the violation was: "Failure to conduct monthly rill and gully inspections:' The problem was abated when the operator conducted a rill and gully inspection on June 1, 1994. The permit application was modified (MR 09) to require annual rill and gully inspections. The notice was terminated on June 9, 1994. The operator was fined $750.00. Notice of Violation C-94-012 Issued May 25, 1994.
