West Elk Mine; p£. 2 <br />No written objections or requests for an informal conference regarding the bond release <br />application have been received by DMG. <br />DFD understands the bond release application applies to approximately 15 acres of reclaimed <br />drill pads and access road disturbance. DMG has calculated the performance bond amount <br />applicable to the reclaimed disturbance areas described above is $ 132,879. Phase I bond release <br />is limited to 60% of this amount (Colorado Rule 3.03.2) or $ 79,727. OSM concurs with these <br />dollar amounts, and the release of $ 79,727 for completion of Phase I requirements. Phase I <br />liability for backfilling, grading, and drainage re-establishment is released on the approximately <br />15 acres described above.
