Gattany <br />Division DirecTOr <br />Natural Resource Trustee <br />The Division received Technical Revision OS (TR-OS) for the Boettcher Limestone Quarry, Permit No. M- <br />1977-348 operated by Holcim (US), Inc. Holcim proposes to leave a 5-mile long haul road approximately 30- <br />40 feet in width at the Boettcher Limestone Quarry. The approved permit depicts a post mining land use of <br />rangeland habitat. <br />Section 34-32.5-116(4)(a) of the Colorado Land Reclamation Act for the Extraction of Constmction Material <br />states that grading shall be carried on so to create a final topography appropriate to the final post-extraction <br />land use selected. The Division does not agree with the operator that leaving a road 30-40 feet wide is <br />compatible with the post mining land use of rangeland habitat. Such finding was stated on page 3 of the <br />Division's inspection report of October 28, 2004 which states, "the approved reclamation plan does allow <br />roads to be left in the azeas to be reclaimed. However, the nature of these roads must be compatible with the <br />post mining land use of rangeland, meaning that roads that will remain must not be excessively wide, and must <br />not require high frequency maintenance." <br />As an alternative to leaving the haul roads in their current configuration, Holcim may opt to reduce the width <br />of the haul roads to be more compatible with the end land use. Holcim will need to specify the reduced road <br />width, describe the reclamation measures that will be taken to reclaim the excess road areas and describe any <br />drainage features to be constructed or to remain (i.e. drainage ditches and existing or new culverts). <br />Please be advised that Division's decision due date is set for June 8, 2005. If you fee] more time is needed to <br />complete your reply, the Division can grant an extension to the decision date. This will be done upon receipt <br />of a written waiver of your right to a decision by June 8, 2005 and request for additional time. This must be <br />received no later than the deadline date.
