Although NCIG included more <br />detail on the history and location of the tipple area with respect to the <br />disturbed area, it still needs to be clarified that this tipple area is within the <br />permit boundaries, and should also be delineated on a map. <br />Irrigation <br />19) NCIG still needs to indicate whether the proposed irrigation pond is located <br />within the permit area and, if so, then the appropriate pond designs should <br />be submitted to the Division. The pond would be subject to regulations <br />governing impoundments (4.05.9). <br />Bacldill and Grading <br />20) NCIG proposes. to leave the benches in place in order to enhance the <br />agricultural utility of the area. Rules 4.14.1 and 4.14.2 require that all areas <br />disturbed in conjunction with an underground mine be returned to <br />approximate original contour. Rule 4,14.2(1) indicates that, "post-mining final <br />graded slopes need not be uniform but shall approximate the general nature <br />of the pre-mining topography." The topography proposed by NCIG with two <br />terraces would approximate the general nature of the pre-mining topography. <br />NCIG's proposed grading plan for the facilities azea could be approved if the <br />regulatory requirements for use of cut and fill terraces in Rule 4.142(2) aze <br />addressed. Specifically, the permit should: <br />a) Explain how the proposed terraces are compatible with the <br />postmining land use and help control erosion (4.14.2(2). This <br />should include a distinct delineation of which areas are <br />intended to be used as dryland pasture and which will be <br />rangeland, Figure 4.7-3 indicates pasture will extend onto the <br />
