MR-52 Adequacy - PCC <br />September 28, 2001 <br />Page 3 of 3 <br />purchasers of each the load out facility, the office, and the warehouse; (b) signed term sheets for the <br />sale of the load out facility, the office, and the warehouse; (c) the name and telephone number of the <br />person at the purchaser of each of the load out facility, the office, and the warehouse who can verify <br />that the purchaser indeed intends to purchase the load out facility, the office, and the warehouse, as <br />the case may be. DMG may contact that person in order to satisfy itself concerning the terms of the <br />alleged purchase. DMG may also seek financial information on the purchaser, in order to determine <br />whether the purchaser is capable of performing under the purchase contract. <br />Such significant revisions to the permit must be addressed with a Permit Revision, as required by <br />Rule 2.08.4. Please be advised that the proposed changes to the Roadside Refuse Pile may not be <br />approvable in any form. <br />The postmining land use changes contemplated with the current minor revision application cannot be <br />approved by the minor revision process. Powderhorn Coal Company may submit a Permit Revision <br />to address the proposed postmining land use changes at any time. <br />2) Revise the proposed Figure 14-1 to indicate the currently approved reclamation schedule for all of <br />the reclamation tasks separately listed in Number ]above. Regrading, cover placement and rock <br />placement on Bench 4 and the top of CRDA-1 could be extended to June 30, 2002 to accommodate <br />reclamation of the facilities areas under the currently approved schedule. Likewise, revegetation of <br />Bench 4 and the top of CRDA-1 could be extended to the end of 2002. <br />3) The proposals pertaining to the Powder & Cap Magazine (Note 1) and the culvert under Excel <br />Energy Road (Note 4) can be approved. <br />Thank you fgr your cooperation. <br />Program Supervisor <br />
