The currently approved and required reclamation schedule is based <br />upon certain approved postmining land use provisions, as described in Permit No. C-81-041, Tab 15. <br />The currently approved reclamation plan and schedule is required to ensure compliance with Rule <br />4.13 (Contemporaneous Reclamation). <br />The proposed changes constitute significant deviations from the approved plan and are based upon a <br />referenced intent to apply for a postmining land use change. Such changes are contemplated at Rules <br />2.05.5 and 4.16.3. Use of the site for commercial purposes may be allowable in accordance with <br />these Rules; however, such an alternative land use and any associated reclamation plan or schedule <br />change proposal, must be approved with due consideration to various factors, including a feasibility <br />demonstration (4.16.3(2)).
