PAGE 2 <br />SEPTEMBER 2fi, 2006 <br />(f) No specific engineering was done when the material was placed as <br />none was required buy Colorado Department of Health regulations <br />applicable at the time. We found that as the fill material was <br />placed it was compacted by the dozer and loaders used to move the <br />material into the excavated area. It is nearly impossible to test <br />for compaction on this type of fill since it contains fairly large <br />dense pieces of material that do not compact. In general the finer <br />particles of dirt, asphalt and concrete fragments filter around the <br />larger pieces leaving few voids so the fill is stable when done. <br />The "OPEN SPACE" areas shown on the PUD map were undisturbed areas <br />around the mined and filled area. Along the railroad tracks this area <br />has been vegetated. In the northeast corner contains a spring that has <br />served the property for many years. Originally it was used to irrigate <br />the farm prior to mining. A small pond was created when the area around <br />it was filled to keep the water from running across the property. The <br />water now flows along the north side of the property until it soaks back <br />into the ground before reaching the railroad. This spring will remain <br />when reclamation is complete. There will be no stormwater control <br />facilities left on the site when reclamation ends. However, once the <br />Reclamation Permit is released and full development can be completed this <br />site will have stormwater retention facility (s) as required. <br />Recycle asphalt and concrete are inter materials by definition so <br />there are no toxic or acid forming material on the site, nor will there <br />be any left on the site post-mining. <br />The smaller western parcel {Lot 1-Block 2) will be graded and <br />leveled as shown on the map. This is consistent with the PUD which <br />states the parcel will be used for equipment storage, truck parking and <br />other uses allowed on the PUD. As noted in the text on the PUD map for <br />that area, a screening berm will be put along the highway and landscaped <br />within 3 to 5 years after filling is complete. The landscaping was a <br />condition placed on the PUD to get it approved and has nothing to do with <br />the reclamation plan. We feel it is a voluntary activity that is the <br />landowners prerogative, The berm construction, tree planting and seeding <br />of the berm are over and above what is required in our reclamation plan <br />and we prefer to keep it this way. <br />I hope these responses are what you are looking for and if you have <br />any questions please call me at (303) 289-1837 or Steve O'Brian of <br />Environment, Inc.
