The response information is <br />responded to in the order presented in your letter. <br />There are no lakes left on the mine area at this time nor will there <br />be any when reclamation is complete. The following text deals with the <br />importation of structural fill into this pit as required in Rule <br />3.1.5 (9) (a) thru (f) . <br />(a) The backfill material placed in both parcels of Frei Pit #3 was <br />"Inert Material" as defined in Rule 1.1(13). The material placed <br />below the water level was aged concrete, dirt, crusher fines and <br />masonry products. Any asphalt that was delivered was reserved and <br />placed above the water line. Filling start in the northeast corner <br />of the mined area and worked counter clockwise around the mine in <br />the eastern parcel and from south to north on the western parcel. <br />(b) There are no records of how much material has been imported since <br />1983. But we estimate that approximately 180,000 cubic yards of <br />gravel was removed during the life of the mine. In addition, the <br />area mined has been backfilled to a level approximately 10 feet <br />above the original ground surface. From this we estimate that <br />386,500 cubic yards has been placed to date. <br />(c) Attached is the signed affidavit as defined in Rule 1.1(20) <br />affirming that this material was clean inert material. <br />(d) Our records show that filling started in 1983 and ended this summer. <br />(e) The post mining land use was unclear when the reclamation plan was <br />approved in 1979. TR2 clarified the end use as being indus- <br />trial/commercial and the county permit allows that use. The filling <br />of the lake and mined area allowed us to utilize the site as <br />originally planned. Review of the site shows that the backfilling <br />has successfully been complete and it is compatible with the <br />proposed use. <br />
