Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your adequacy review responses for the Russell Gravel Pit, Conversion Application <br />(CN-Ol) for pemrit No. M-1994-096. The Division has the following comments that need to be addressed <br />prior to approval of the application. <br />1. Please submit a copy of the newspaper affidavit to document [hat the notice was published in a newspaper <br />of general circulation. <br />2. Please describe the methods of weed control that will be employed for all noxious weed species on site. <br />The applicant will need to include a mitigation plan to control all noxious weeds and plan of <br />implementation in the event a weed problem exists. <br />3. Please state the depth to groundwater in the azea to be mined. In order to not affect the groundwater <br />system, the operator will need to commit to staying two feet above the seasonal high water elevation at all <br />times during mining and reclamation of the site. <br />4. Please submit the signed agreement between High Plains Sand & Gravel, LLC and the Colorado <br />Department of Transportation to address strncttues located within 200 feet of the permit azea. As an <br />alternative, the operator may demonstrate that a mining distance of less than 200 feet will not adversely <br />affect the road. <br />5. Attached, please fmd a copy of the Division's reclamation cost estimate for the site. The estimate was <br />based on a phased mining operation, where only 10 acres will be exposed at any given time. The <br />Division's estimate totals $33,900.00. Please see attached estimate for further clarification. <br />Please be advised that Russell Gravel Pit Conversion Application may be deemed inadequate, and the <br />applicarion maybe denied on February 28, 2005 unless the above-mentioned adequacy review items aze <br />addressed to the satisfaction of the Division.
