- ~ -• <br /> <br />December 1, 1988). The reason for this change is that AOBCO <br />originally anticipated the Stage One to be mined out more quickly <br />based upon their estimates of the market. The market has been much <br />slower with the downturn in the economy during the mid 80's to the <br />present time than ROBCO anticipated. As a result, the deposit <br />contained in Stage One will last 15 years longer than originally <br />anticipated. Taking into account the change in the land area and <br />the change in timing, the new timetable should be revised to read <br />as follows: <br />Stage Years Total Acres +/- Mines Acres +/- <br />1 35 27.68 24.90 <br />2 20 - 30 58.40 54.23 <br />3 10 - 20 44.38 35.96 <br /> <br />TOTALS <br />-------- <br />-------- <br /> <br />------------- <br />------------- ----------------- <br />130.46 <br />-------------------- <br />-------------------- -------------- <br />115.09 <br />--------------- <br />--------------- <br />In reading the definition of a technical revision in the CMLRD <br />Rules and Regulations it states that a TR is a change in the permit <br />which does not have mare than a minor effect upon the approved <br />reclamation plan. We believe that this request fits that <br />definition as we are not asking for any changes to the reclamation <br />plan other than reduction of acreage (which was imposed upon ROBCO <br />by the State Highway Department) and timing of mining in Stage One <br />due to changes in market conditions. In fact, by not requesting a <br />reduction in the financial warranty, the financial warranty now <br />covers fewer acres meaning a higher dollar per acre warranty than <br />the CMLRD previously held. <br />Attached are two exhibits. Exhibit A shows the CDOH taking for <br />C470. Exhibit H is the revised Mine Plan map which shows the total <br />area in grey of 35.45 acres which we are requesting to be removed <br />from Stage One as well as the revised area of Stage One which is <br />27.68 acres in size. We have not shown Stage Two or Three as they <br />remain the same as in the original permit. The new west boundary <br />line of Stage One is the east boundary of the property taken for <br />C470. The north, east, and south boundaries remain the same as in <br />the original permit. <br />Please let me know if this information is sufficient or if anything <br />else will be needed to successfully complete this TR request.
