The County Commissioners were notified of this application on June 20, 1997. That notification
indicates that the entire application is available for review at the Division offices and at the
County Clerk and Recorder's Office. This was not the case. The Division did not receive the
application until October 7, 1997 and the County Clerk signed for receipt of the application on
October 6, 1997. Please re-notify the County Commissioners of this application. If a statement
is obtained from the County Commissioners, indicating that they have no comments or concerns
regarding this application, the comment period for their response can be waived.
STRUCTURES
9. The permanent manmade structures exhibit (Exhibit S) included in this application was not for
this site, but for the Stone Pit application. Please submit the correct permanent manmade
structures exhibit for this site.
APPLICATION
10. The application form indicates incidental commodities to be mined include gold and borrow
material. The mining plan indicates that there will be no incidental commodities mined, Please
clarify.
RECLAMATION COST ESTIMATE
11. The reclamation cost estimate will be recalculated to include costs for reclamation of both the
Current 1 10c permit area, the North-Central Unit, and the Northwest Unit unless the operator
commits to completing reclamation of the North-Central Unit (except revegetation establishment)
before initiating any disturbance of the Northwest Unit. The calculation will have to be area wide
for each of these units unless more detail of maximum disturbance at any one time is provided,
ie: maximum highwall length and height, maximum acreage of processing and stockpile area, and
maximum pit area to be in place at any one time.
OTHER
Upon review of the CN-01 application maps and the aerial photograph of the site, coupled with
comments in the Division's most recent inspection report for the West End Gravel Pit, it appears that
mining has occurred outside the currently approved permit boundary. This possible violation will be
handled as a separate issue. A letter indicating the Division has reason to believe a violation exists at
this site will be forthcoming.
If you have questions or need additional information, please contact me at our Durango Field Office, 484
Turner Drive, Building F, Suite 101, Durango, Colorado 81301, phone no.
