111 IIIIIIIIIIIIIIII <br />sss <br />Permit~~s C) <br />L:a Poudre Sand & Gravel Site; M-83-090 <br />l i/17/83 MLRB issued a 112-Mining and Reclamation Permit to La Poudre Sand R Gravel Inc. with a <br />permit area of 242.6 acres. <br />As specified in the Weld County Special Use Permit, the site is located in a "Flood Hazard District <br />Overlay Area." Operation standards in the Weld County Special Use Permit address operations <br />within the flood~~way/flood plain, specifically in the Weld County flood Hazard Regulations. <br />6/2/94 Pemtit transferred to Hall Irwin Consttvction Company. <br />7(1194 DMG approved Technical Revision 001 to move the concrete batch plant and wash plant to the <br />north side of the property. A letter from Weld County states that the county may require a <br />building and flood hazard perm[ prior to [he move. <br />5/2/99 Flooding along Cache La Poudre River. USGS daily mean streamflow data indicate peak <br />discharge in river 2,800 cubic feet per second (cfs). <br />5/14/99 DMG inspected the site due to exposure of the Sinclair Pipeline between Pits #3 and #4 as a result <br />of the "flood". f(t that time the operator stated that a slurry wall had been constructed around Pits <br />#3 and #4 in 1997. Under the corrective actions in the inspection report, the operator was required <br />to submit a revision to the permit to provide a plan that will address protection of the Sinclair <br />Pipeline, change a portion of the post mining land use to "developed water resources," and submit <br />a plan to conrol noxious weeds on site (specifically Leafy Spurge). Due date for the permit <br />amendment was July 23, 1999. <br />At the request of Hall-Irwin, the Division extended the permit amendment due date to September <br />20, 1999. <br />I I /3199 DMG sent a letter to Hall-Irwin stating [hat the Division believes [he Operator to be in violation of <br />the permit for not addressing the issues noted in the 5/14/99-inspection report. Scheduled for the <br />December I5-16 Board meeting. <br />I (/22/99 Hall-Irwin submitted a technical revision to [he permit (TR-002) addressing protection of the <br />Sinclair Pipeline and the control of noxious weeds on site. The technical revision was approved <br />on January 7, 20110. <br />1/21 /00 Hall-Irwin submitted an amendment to the permit (AM-001) addressing the change in the <br />postmining land use from `conservation, wildlife habitat and recreation' to also include `developed <br />water resources.' <br />2/25/00 Objection letter front Mr. Clem McNaney; specifically obstruction of the floodway elevating the <br />ground around the McNaney property and construction of the slurry wall. The Spring of 1999 is <br />when the McNaney's experienced excessive amounts of rain and runotl'where water was backed <br />up on the property due to the elevation of the Hall Irwin property. <br />3/10/00 DMG pre-operation inspection with Tuttle Applegate and Clem McNaney. Mr. McNaney stated <br />the construction of berms around the Hall lrwin property (adjacent [o Weld County Road 13 and <br />the Poudre River} and the installation of the slurry wall has raised the ground water table <br />surrounding his property. Mr. McNaney stated that the basemen[ was not currently flooded. <br />
