<br />including but not limiting to: buildings. houses, barns, fences, above or below ground utilities, <br />irrigation ditches. maintained or public roads, bridges, railroad tracks. etc. The Division is aware of <br />two permanent man-made features within 200 feet of the mine site; Highway 76 and utility <br />poles lines on the west-end of the pit. Where the mining operation will adversely affect the stability <br />of any significant, valuable or permanent man-made structure located within 200 feet of [he affected <br />land, the applicant may either: <br />Provide a notarized agreement between the Applicant and the Person(s) having an <br />interest in the structure, that [he Applicant is to provide compensation for any damage <br />to the structure; or <br />• Where such an agreement can not be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />The applicant will need to submit the notarized agreement or engineering evaluation for the <br />two structures noted above, and any other structure within 200 feet of the affected area. <br />4. Please depict the location of the asphalt batch plant on a map, and describe the measures to be taken <br />to ensure the groundwater and the surface water is protected. <br />5. The Division of Wildlife (DOW) recommends the seed mix be revised to remove the planting of <br />russian olive, hickory and walnut and replaced with native species such as cottonwood and willow <br />and/or a combination of plum, chokecherry and snowberry. The Division concurs with the DOW <br />seed mixture recommendation for the Barlow Pit. Please inform the Division if Dom Ready Mix <br />will revise the seed mix as recommended by the DOW. <br />Once the above mentioned items are submitted, the Division will revise the reclamation cost <br />estimate to reflect the current mining and reclamation plan. Please be advised that the technical <br />revision may be deemed inadequate and the application may be denied on June 7, 1999 unless <br />the above mentioned adequacy review items are addressed to the satisfaction of the Division.
