In Adequacy Item 2, DMG had requested clarification regarding whether thebackfilled N W Intake Portal <br />was included in the release request. PCC clarified that the N W Intake Portal was included in the release <br />request. In [he most recent cost estimate, a direct cost of $643.00 was estimated for the portal backfill seal, <br />and a cost of $1,607.00 for backfilling of the small portal area disturbance (combined cost of $2,250.00). <br />During the bond release inspection on August I5, a small crack a couple feet in length and I-2 inches wide, <br />apparently up to several feet deep was observed along the upper perimeter of the portal backfill. The <br />operator indicated that the crack would be filled in promptly. On the follow-up inspection on August 24, 1 <br />verified that the crack had been filled. Tonya Hammond stated the crack had been opened up with a hand <br />shovel, and dirt tamped in with the handle of the shovel to compact the dirt as it was placed in the crack. <br />Tonya indicated that a relatively small amount of shovel work was required, and that no large void was <br />discovered. It may not be prudent to approve bond release for the NW intake at this time, but rather delay <br />release for a period of time sufficient to evaluate the adequacy of the repair, and stability of the backfill. <br />Adequacy Item 3 requested documentation regarding how the dollar amount for which PCC requested <br />release was derived. A spreadsheet detailing this information was provided. 1 have indicated to the <br />operator that we will prepare an updated reclamation cost estimate, with individual task items deleted or <br />modified to reFlect reclamation work satisfactorily completed, as a component of our bond release review <br />and proposed decision. <br />Adequacy Item 4 requested documentation that CDOT and Union Pacific Railroad were notified of the <br />bond release application, az both are indicated on the land ownership map az permit or adjacent area <br />landowners. This documentation was provided. <br />Adequacy Item 5 requested that CRDA # I and #2 Bond Release Map be amended to delineate specific <br />areas for which Phase 1 bond release was being requested. The map was appropriately amended. <br />Designated areas for which bond release is requested include the lower three benches of both CRDA refuse <br />piles, which have been graded, cover-soiled, topsoiled, and revegetated (in 1994). Bond release <br />considerations pertinent to the CRDA refuse pile lower benches, will be addressed in more detail under <br />Item 8, below. <br />Additional sites in the vicinity of the CRDA refuse piles for which bond release is requested are CBA-1, <br />former Topsoil Pile 5, former Topsoil Pile 6, and reclaimed Access Road 4. Each of these small sites was <br />reclaimed at the same time that the CRDA lower benches were reclaimed, and based on observations made <br />during the bond release inspection, they appear to have been properly graded to blend in with adjacent <br />terrain, in conformance with the approved permit. An apparently effective cover of perennial vegetation <br />has been established on each of these areaz. At CBA-I, a sediment containment ditch and incised sediment <br />trap (CBA-I Sump) remain, and will need to be eliminated once appropriate sedimentation demonstrations <br />have been made, prior to fmal (Phase III) bond releaze. <br />Adequacy Item 6 requested that the North Decline Bond Release Map be amended to delineate bond <br />releaze request areas, and that the 2 West Portals map and South Fan Installation Maps be similarly <br />amended. Each of the requested maps was amended in the revised bond releaze application. <br />The North Decline map az amended accurately depicts the area of completedbackfilling and grading, with <br />certain areas to be excluded from the bond releaze request. The areas delineated on the map as being <br />subject to further work, and thus excluded from the bond release request properly include the east and west <br />SAE sumps, Sediment Pond 7, and a small area to be used for stockpiling of soil from the mine de-watering <br />drilling project approved in TR-33. The map should be further amended to clarify that, in addition to these <br />locations, all perimeter diversion ditches and berths, and sediment collection ditches will also be excluded <br />from the releaze. In addition, berms built up along the permanent channel will need to be eliminated or <br />modified prior to fmal bond release (after required sedimentation demonstratons have been made) to allow <br />for surface runoff from the reclaimed area to enter the channel.
