Conflicts Between Postmining Land Uses and Existing BLM Land <br />Management P an and Pclicies <br />The subject Permit Renewal does not create a conflict hetween <br />postmining land uses and our existing Management Framework Plan or <br />proposed Resource Management Plan for these lands. <br />5. Adequacy of Measures to Protect Federal Resources Not Covered by <br />the Rights ranted by the Federal oal Leases <br />During our meeting with representatives of TCC, the concerns <br />outlined below were discussed and they were agreed upon for <br />incorporation into the mine plan. However, it appears these <br />statements were not incorporated as revisions by TCC. In order to <br />protect federal resources within the permit boundaries the <br />fallowing stipulations must be included in the permit as a <br />condition of our approval: <br />A. No subsurface development or exploration activity will take <br />l'l-S GS place on any lands where all or part of the federal mineral <br />W~, _ _~~ estate is not leased (to TCC) without obtaining a Bureau of <br />/~ Land Management lease, license, or permit. <br />~.~~` B. Including unleased federal minerals/private surface within <br />the permit boundary shall not preclude issuance of other <br />/~yf federal permits or leases to prospect, develop, or produce <br />/~ _ ~~, deposits of federal minerals within the coal mine permit <br />Qt~~ boundary. <br />Until such time that justification is provided to leave the public <br />surface/minerals (T.6N., R86W., 6th P.M., Sec. 33: SWl/45W1/4) <br />within the mine permit boundary and the appropriate use <br />authorization is obtained from the BLM, these lands should be <br />omitted from the revised mine permit boundary. <br />Any questions concerning Item 1 should be directed to Jerry Strahan at <br />(303) 824-8261.
