<br />Mr. James Dillie <br />Adequacy Letter, Apache Mine Permit No. M78-009 <br />Page ] 2 <br />Other Issues: <br />In an April 1999 letter, the El Paso County Soil Conservation District <br />expressed the following concerns. <br />The El Paso County SCD has reviewed your amendment to the Apache <br />permit and have the following comments: <br />1. There is a large terrace in the upper part of section 20. /f <br />sediment frlls it will not operate effectively. The terrace is <br />protecting a headcut that enters Brackett Creek. <br />2. There is a series of ponds and wetlands on the sau[hern edge of <br />section 20. This area will need proper protection. <br />3. Haw much land will be open at any one time? We s[rongly <br />recommend concurrent reclamation to minimize t/re amount of <br />land that might become eroded by either wind or water. <br />4. What would be the recommended seeding rate and species that <br />you will use to reclaim the pit once mining is completed? <br />S. Do you have a noxious weed contra/ plan in place? <br />ROBCo has reviewed the questions and is confident the permit addresses the EI Paso <br />County Soil Conservation District's (SCD) concerns. SCD Items 1, 2, and 3 aze <br />addressed in multiple azeas of the permit, but the most prominent commitment to these <br />items is "A total disturbed azea at any one time will not exceed 39 85 acres. Of that 3@ <br />85 acres, no more than ~5 40 acres will need partial backfilling and recoiling; any <br />disturbed acreage on the remaining d-3 45 acres will have been backfilled and recoiled and <br />in the final stages of reclamation. Of the 45 acres, 20 acres will have been seeded, <br />leaving 25 acres for seed and fertilizer." The secondary commitment to these items is <br />the stormwater management plan outlined in the Division's Item 6 above. <br />SCD Item 4 is addressed in the specific seed mixtures and rates discussed in the <br />Division's Item 7 above. And, SCD Item 5 is addressed with the following addition to <br />Page 16 of Exhibit E in response to the Inspection Report prepared by James Dillie at the <br />Division upon completion of the October 26, 1999 Division Inspection. <br />During the early spring, on an annual basis, Robinson Brick <br />Company will inspect the Apache Mine permit area to determine if new or <br />additional weed control measures are required. If a tweed noxious weed <br />problem continues, ROBCo will take whatever reasonable steps are <br />necessary to eliminate these problems. If, for whatever reason, ROBCo is <br />not able and/or successful in controlling the kxw noxious weed problem <br />at the Apache mine, ROBCo will contact the Division for further assistance. <br />
