The City of <br />Golden's outside Counsel, Don Ostrander of Duncan, Ostrander, & Dingess, is preparing <br />a response to the objections raised by Amanda Bradley of Hale, Hackstaff, Friesen. This <br />response will be submitted to the Division separately. <br />This letter will address the concerns regarding fugitive dust control at the site. <br />T'he City of Golden constructed the Guanella Reservoir at the site of the Empire Pit in <br />2003 and 2004. During construction, approximately 750,000 cubic yazds of gravel <br />reserve remaining at the pit were excavated and stockpiled on-site. The construction and <br />stockpiling effort was completed on January 23, 2004. <br />Once construction was complete, Golden contracted to have the stockpile stabilized using <br />a hydro-mulch, seed, and tacifier. This application was scheduled to begin on February 2, <br />2004, but was delayed due to weather until Mazch 2004. The hydro-mulching effort was, <br />unfortunately, largely ineffective, due to the steep slopes of the stockpile. <br />In Mazch 2004, Golden met with representatives of Cleaz Creek County and the Town of <br />Empire to discuss their concerns with the stockpile. During that meeting, Golden <br />committed to regrading portions of the pile to reduce visual impacts of the pile and with <br />the hope that some of the wind effects could be reduced. In addition, Golden committed <br />to stabilize the stockpile by applying a surface ratifier. <br />In June 2004 the pile was re-graded. The east end of the stockpile, which had been the <br />highest point, was lowered to match the grade of the middle and the entire top was <br />flattened. <br />
