of 2000, and that completeness determination, work session(s), and public notices be made in <br />• anticipation of final action in June of 2000. <br />CC&V further requests [hat this amendment application, when approved, be considered a vested <br />property right pursuant to Section 24-68-104(2), C.R.S. and Section VE-10 of the Teller County <br />Land Use Regulations. CC&V also requests that a development agreement be executed <br />confirming the vested rights for a period of five years from the date of this amendment <br />application approval. Notwithstanding the foregoing, such vesting is not intended and shall not <br />be constmed to limit [he nature or duration of any activities authorized by this amendment <br />application. <br />Sections 3.3 and 3.4 of the proposed CCMOD regulations also require scheduling of work <br />sessions and hearings on the proposed application. The above noted completeness <br />determination, work session, public notices, and public hearings equally would satisfy the <br />proposed CCMOD regulations. <br />"Property posted 30 days before bearing: " <br />CC&V has posted the property in conjunction with the posting required for the OMLR Amendment <br />No. 8 application to Permit M-80-244. The notice was posted on March 24, 2000 at the following <br />locations. <br />• CC&V's Victor Administration Office <br />• Along State Highway 67 at the Cazlton security office, adjacent to the OMLR permit <br />• sign <br />• Along State Highway 67 at Arequa Gulch, adjacent to OMLR permit sign <br />• Along State Highway 67 at Squaw Gulch, north side of road adjacent to gated entrance <br />• Along State Highway 67 at Squaw Gulch, south side on County Road 881 <br />• Along County Road 82 at the entrance to the Ironclad facilities <br />• Along County Road 81 at the intersection of County Road 831 and County Road 82, <br />adjacent to the Teller County Focus Group information sign <br />The language of posting is outlined in Attachment 2 to this document. Also contained in <br />Attachment 2 is a signed statement that such signs were posted. <br />The PUD requirements of the proposed CCMOD regulations also require that the property <br />be posted. <br />"Notice neailed 30 days before bearing (to all ad~oinine properly owners as per NO-40-3): " <br />A copy of the public notice was sent, certified mail, return receipt requested, to all adjacent land <br />owners within 200 feet of the proposed permit boundary (other than CC&V) as part of the notices <br />for Amendment No. 8 under the MLRB's regulations. This notice was mailed on March 24, 2000. <br />The list of persons and entities notified is contained in Exhibit O of the Amendment No. 8 <br />application (Volume 1).
