TABLE 4 -REVIEWING AGENCIES <br />• For each reviewing entity listed in Teller County Land Use Regulations Table 4 specific to CUP - <br />Mining, CC&V has included information which may be applicable to the reviewing agency and, <br />where appropriate, provided a reference to additional information in this application document. <br />The discussion is designed to assist with identifying material useful to the reviewing agencies, as <br />well as noting the prior involvement of these entities in the Cresson Project. <br />The PUD requirements, as referenced by the proposed CCMOD regulations, list agencies in <br />Teller County Land Use Regulation Table 4 in addition to those listed for aCUP -Mining. <br />The information provided below related to CUP -Mining, thus, equally satisfies similar <br />requirements for a PUD. The information provided below also addresses the additional <br />agencies listed for a PUD. <br />Colorado State Forest Service: <br />All lands proposed to be disturbed are privately owned rather than public lands managed by the <br />Bureau of Land Management ("BLM"), U. S. Forest Service ("USFS"), or State-managed lands. <br />Some lands within the permit boundary aze administered by BLM and the State Land Board and <br />these agencies have been notified. The reclamation plan for the Cresson Project (see Amendment <br />No. 8 application, Volume 1, Section 11.0 of the Project Description) is subject to review and <br />approval by the OMLR. Planting of trees and shrubs is addressed in the reclamation plan. The <br />Colorado State Forest Service does sell seedlings which previously have been used in some areas of <br />• the Cresson Project reclamation. <br />Colorado Ceo%ical Survey ("CCS'7: <br />CC&V worked with CGS to develop a geologic map of the District. Information related to the <br />geology of the District is provided in Amendment No. 8, Volume I, Section 4.4 of the Project <br />Description. <br />Colorado Department o(Public Health mrd the Environment ("CDPHE"): <br />CDPHE has issued permits to CC&V for the Cresson Project for (1) air emissions, (2) management <br />of certain wastes (potentially hazazdous wastes), (3) potential water discharge from the project <br />areas, including the valley leach facility (which is anon-discharging facility) and Arequa Gulch, <br />(4) the Carlton Tunnel discharge, and (5) storm water runoff. A list of other permits or approvals <br />applicable to the Cresson Project is provided in Amendment No. 8, Volume I, Exhibit M. <br />CC&V is in the process of preparing a modification to the air emissions permit for the Amendment <br />No. 8 activities for both fugitive and point-source emissions. The application will be submitted to <br />CDPHE in the neaz future. Upon approval, a copy of the permit will be provided to Teller County. <br />CC&V's current operations are conducted in accordance with a valid facility-wide air quality <br />permit, a copy of which is provided in Attachment 8 of this document.
