LOns <br />Dwision Dircaor <br />On 5/24/99, DMG received the 5150 application fee for Technical Revision N2 (TR-02) to the Dalton <br />Land & Cattle Pit, addressing the post mining land use for the processing area. Therefore, the <br />application 'for TR-02 has been found complete for the purposes of filing. Pursuant to Rule 1.9.1, <br />DMG decisir~n date is 6/23/99. <br />The requested modification to the post mining land use will update the DMG permit to appropriately <br />conform with the zoning conditions of the La Plata County Permit System, as approved by the Board <br />of County Commissioners through Resolution No. 1993-55. <br />Please be advised that TR-02 may be deemed inadequate and may be denied on 6/23/99 unless the <br />following adequacy review items are addressed to the satisfaction of DMG. <br />Adequacy Issues <br />DMG interprets a change in the post mining land use, from the existing pasture land to industrial land <br />use, as a significant revision to the reclamation plan. Significant revisions to the reclamation plan are <br />appropriatel~,r processed as an Amendment to the permit, as defined by Rules 1.1(6) and 1.10, and <br />Section 34-32.5-112(7)la) C.R.S., of the Act. However, given the unique conditions of this specific <br />site, DMG offers the following response to your desire to submit such modification through the <br />Technical REvision (TR) process. <br />DMG will prl3cess your request, to modify the post mining land use for the Dalton Land & Cattle Pit <br />processing yard from the existing pasture land to industrial land use, as a TR subject to the following <br />three conditions: <br />1. Sandco must waive its right, in writing, to a decision on the TR within the standard 30 day <br />revie~nr period; <br />2. Sandco must satisfy the public, agency and landowner notice process that attends submittal <br />of an Amendment, including the four weeks of publication with the standard public comment <br />periolf, as described in Rules 1.6.2 and 1.6.5. <br />
