McArdle, Senior declamation Specialist <br />RE: File No. M-86-122 <br />Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the <br />applicable requirements of C.R.S. 34-32-101 et seq. and the t4ineral Rules and <br />Regulations of the Mined Land Reclamation Board- <br />The Brownwood Pit No. 2 is essentially increasing the acreage of the affected <br />land permitted in File No. M-79-059 (Brownwood Pit No. 1). The staff, <br />therefore, interprets your application to be an Amendment to M-79-059 and not <br />an application fora new permit. As such, this application for amendment <br />needs a map and an application with the same content as required for the <br />original application but which is inclusive of both the Brownwood No. 1 and <br />Brownwood No. 2 pit sites. <br />Please respond to the following adequacy items <br />amendment comprehensive: <br />13.~Acreage <br />)1 f Are there 53.8 existing affected acres <br />)/ / operation? <br />to make your application for <br />in the Brownwood No. 1 <br />/ Are there 64.9 amended affected acres in the Brownwood No. 2 operation? <br />3~. You will be refunded accordingly. <br />i <br />17.> Proposed Future Use <br />Your proposed future land use of Agricultural and Ponds for the <br />amended acreage is not considered a beneficial use according to Rule <br />6. Please commit to an accepted beneficial post-mine land use.
