Following aze a few <br />items of concern that need to be addressed in order to comply with the minimum requirements of ' <br />the Construction Materials Act/Mineral Rules and Regulations: <br />1. The Division's records show that the Penrose Ranch permit contains 236 acres; 224 acres <br />in the original application and an additional 12 acres from amendment number one <br />(1995). If the Division's records aze accurate, you must correct page 1 of the application <br />and submit the revised document. <br />2. Since this is an amendment application, the applicant shall clearly describe where in the. <br />original application and supporting documents the information that is not included in this <br />application may be found (Rule 1.10.1(1)). <br />3. Exhibit A - OK. <br />4. Exhibit B - OK. <br />5. Exhibit C -Remove Conditional Use Permit designation, Amended Conditional Use <br />Permit and other references to CUP and CUP numbers (Penrose Ranch and G&V permit) <br />from the maps. <br />Is the "Mining Boundazy" the permit boundary or the affected land boundary? If it is the <br />permit boundazy, where is the affected land boundary? Pursuant to Rule 6.4.3, the total <br />area to be involved in the operation, including the area to be mined and the azea of <br />affected lands must be legibly portrayed on the Exhibit maps. <br />Pursuant to requirements of Rule 6.4.3(a), all adjoining surface owners of record must be <br />shown on the pre-mining map or the mining plan map. <br />The pre-mining map must show the type of present vegetation covering the affected lands <br />(Rule 6.4.3(e)). <br />The owner's name of the stmctures contained on the azea of affected land and within 200 <br />feet of the affected land must be shown on the Exhibit maps (Rule 6.4.3(g)). <br />6. ExhibitD -show overburden and topsoil stockpile locations on the mining plan map. <br />At what point during the mining operation will the operator strip and place topsoil on <br />completed mining areas? <br />
