LEGAL RIGHT TO ENTER (changed) <br />Exhibit N <br />Source of Legal Right-To-Enter <br />FOR LAND OWNED BY STATE OF COLORADO <br />The source of the legal right to enter and mine the affected land is provided by a lease from <br />the State of Colorado, State Board of Land Commissioners. The lease is General Quarry Lease No. <br />QR 3332. This lease is for a total of 320 acres and includes the SW '/a of Section I4 and the NE '/a <br />of Section 22. The NW '/a of Section 23 will be included in a separate lease that allows for only <br />surface use. Lease documents are available upon request or may be examined at the State Board of <br />Land Commissioners' office. <br />The access road to the property is not included in the lease but is totally on State of <br />Colorado land administered by the State Board of Land Commissioners. Access to the lease area is <br />provided in the lease. Issues regarding the access road were addressed fully during the processing <br />of the original permit. This road is no longer available for public use. The permitted portions of the <br />access road start at the edge of the NW '/a of Section 23. However, the use of this road, except <br />within the immediate area of the mining operation, will not be for the exclusive use of Castle <br />Concrete. Other lessees, as well as the Colorado Division of Wildlife, and the United States Bureau <br />of Land Management have full rights to utilize the roadway. Public access to this land is now <br />provided by foot only from the north side of Table Mountain in the Beaver Creek drainage. <br />FOR LAND OWNED BY BUREAU OF LAND MANAGEMENT <br />The source of the legal right to enter and mine the affected BLM land is provided by a <br />"Contract for the Sale of Units of Materials" number CO-200-MS-00-1.
