(e) the names of individuals that requested any pre-blast surveys, the dates these pre-blast <br />surveys were conducted, and the dates that copies ofpre-blast surveys were supplied to <br />these individuals. <br />2. Rule 4.08.2(1) requires additional pre-blast surveys be performed whenever a structure located <br />within one-half mile beyond a mine's pemrit boundary is renovated or added to subsequent to an <br />initial pre-blast survey, and a request for an additional pre-blast survey has been submitted to the <br />Division. <br />At the time that the initial pre-blast survey notifications were sent, were the residents of <br />dwellings and owners of structures informed of this provision? If so, how? If not, the Division <br />recommends that notices be sent to those individuals who previously requested pre-blast surveys <br />infomung them that if they will be adding, renovating, or replacing structures within the next <br />five years, they aze entitled to receive an additional pre-blast survey upon submitting such a <br />request to the Division. <br />If TMI believes an alternative method of notification is more appropriate, please discuss this <br />alternative method. <br />Rule 4.08.3(1)(a) requires blasting schedules to be published in a newspaper of general <br />circulation in the locality of the blasting site. Rule 4.08.3(1)(b}requires copies of blasting <br />schedules be distributed by mail to local governments and public utilities, and be distributed by <br />mail or delivered to each residence within one-half mile of the blasting site described in the <br />schedules. Rule 4.08.3(1)(c) requires that blasting schedules be republished and redistributed by <br />mail every 12 months. <br />Section 3.4.2 Public Notice of the TMI perrnit (page 3-28) states, "Copies of the blasting notice <br />will be sent to local governments and public utilities. Any residence within one half mile of the <br />proposed permit area will also receive a copy of the blasting notice as well as information <br />advising the resident or owner how to request apre-blasting survey." <br />Please update this paragraph to identify the specific local governments, public utilities, and <br />residences to which these sentences will apply during the next five-year permit term. Please also <br />update this pazagraph to state that the blasting notice will be re-distributed by mail to these <br />entities every 12 months during the next five-yeaz permit term. <br />Please be aware that while TMI has committed to provide copies of the blasting notice to <br />residences within one-half mile of the permit area, Rule 4.08.3(1) requires the blasting schedule <br />to be sent to residences within one-half mile of the blasting site(s) described in the schedule. <br />TMI may wish to revise its permit to reflect this requirement. <br />Please be also aware that the annual mailings of the blasting schedule to residences within one- <br />halfmile of the blasting site(s) need not contain information regazding pre-blast surveys. <br />As a side note, we suggest that TMI consider conducting these annual mailings via certified mail <br />with return receipts requested, so as to be able to demonstrate compliance with Rule 4.08.3(1)(c) <br />should such a need ever arise in the future. <br />C-1981-010 RN04/PROS 2 08/29/02 <br />
