This mid-term review was <br />conducted in coordination with the Colorado Mined Land Reclamation <br />Division (NERD), and their Mid-term Review Document is incorporated as an <br />integral part of this memorandum. <br />OSMRE/WFO has reviewed the Federal permit, including conditions, and the <br />administrative record, and has determined that the permit terms and <br />conditions are being satisfactorily met. The Albuquerque Field Office <br />reviewed inspection reports, the enforcement record, and citizen <br />complaints, and has determined that there are no problems inherent in the <br />permit or reclamation and operation plan of the approved permit <br />application package (PAP) that have resulted in compliance problems. <br />The surface lands within the permit area are all privately owned. All of <br />the coal which has been mined is located in the upper "E" seam of the <br />Upper Cretaceous Mesa Verde Formation. Approximately 4 percent of the <br />lower "D" seam coal within the permit area is Federal, within lease no. <br />D-036906. The mine has been in temporary cessation since April 19, <br />1983. The HEM, Minerals Management Service did not identify any issues <br />needing resolution in the permit conditions, lease conditions, or other <br />portions of the PAP including the resource recovery and protection plan. <br />However, Federal lease D-036906 was readjusted on January 24, 1984, and <br />is subject to a change in the royalty rate. Grand Mesa Coal Company also <br />holds Federal lease D-055156 which is adjacent to the permit area and was <br />modified in August 1986. This lease is outside both the State and <br />Federal permit area; therefore, this coal cannot be mined without an <br />approved mining plan modification. <br />
