<br />January 30, 1985 <br />Paige Seville <br />Page Two <br />The second item that requires a stipulation concerns backfilling the seal of <br />the fan portal. Although Mt. Gunnison has committed to sealing the portal <br />area, it was not clear how much backfilling was to be done. The Division is <br />not requiring WECC to import any material to fully backfill the pad, however, <br />WECC needs to push fill from the pad into the portal to backfill against the <br />seal. The objective is to eliminate any sign of a portal or indentation in <br />the hillside (similar to what was done at Bear No. 1 Mine). The following <br />stipulation is required: <br />Stipulation #TR-2 <br />West Elk Coal Company, during reclamation, shall use existing fil] from <br />the fan pad to backfill against the seal of the portal to eliminate any <br />portal or depression in the hillside (bringing the entire fan pad back <br />to original contour is not required due to the steep slope, existing <br />configuration, and limited fill available). <br />In order to keep track of these stipulations in future years, the Division <br />requests t.~iat you revise your reclamation plan in the application to include <br />the backfilling requirement. A copy of the analysis should also be inserted <br />in the hydrology section. <br />If WECC agrees to the above stipulations, the attached public notice may be <br />published once in a local newspaper. Your revision will be approved if no <br />public comment is received within 10 days of the publication.
