A few weeks <br />ago, during a San Mrguel County Board of Comrrrissioners meeting, Ms. Gaston brought up this <br />issue at which time I clarified that the parcel is not four acres and is not a lease but a short term <br />easement agreement. By my calculation, the parcel (excluding our access road) is approximm~ttely <br />1.94 acres. <br />In addition, during our application for the conversion in 1992, I had numerous conversations <br />with Ms. Gaston regarding the visual impacts of our gravel operation. During those discussions, <br />we talked about low profile gravel piles and leaving an existing berm on the west side to block <br />the view of the operation. At this time, Ms. Craston was fully aware of our intern to allow <br />Skelton to stockpile on the 1.94 acre parcel, because I infonred her that if Skelton didn't <br />steckp;~e on this parcel, San Rogue! County vnuld. <br />Tyre County fully irrterds to mule toward the northeast corner of our land, aryl in no way does <br />our easement agreement with United Companies prevent us from doing so, as stated by the Ms. <br />Gaston. <br />Obviously, you are aware that the County rrnrst corrlply with the Colorado Depamrrent of Health, <br />Air Pollution Control Division's regulations. It was deterTrurred that no permit is required as <br />errvssior>s of particulate matter will be less than five tons per year. An Air Pollution Finission <br />Notice (APEN) is required as PM-10 Emissions will be more than one ton per year. <br />P.O.
