Erickson, Envvonmental Protection Specialist ~_ <br />Colorado Division of Minerals and Geology <br />Durango Field Office <br />1474 Main Avenue <br />Room 207 <br />Durango, Colorado 81301 -- 5182 <br />Re: Wallace Pit Permit Number (M--083--028) <br />Dear Mr. Wallace: <br />Receive <br />~IV+ - <br />Divisnn cf i'.::,;~: ~:, ~ GccIo9Y <br />We aze responding to your adequacy review letter dated November 4, 1995, for the above <br />referenced permit. <br />Concerning PB-4 our annual reports have shown that no distwbance has occurred at the <br />location, is a misunderstanding on our part. Please see a copy of our last annual report, <br />which now indicates a disturbance at the Wallace Pit. No material has been removed from <br />the azea and over the years this was misunderstood to be the same as a disturbance at the <br />pit. If you require additional information or have any questions on this matter, please call. <br />Concerning the Notice of Temporary Cessation, following is our response. <br />a) The date of cessation. The date of cessation is August 30, 1995. <br />b) The reason for non-production or cessation of the mining operation. We have not <br />used the pit to date, because we have not needed the source for a project. Our <br />company anticipates that we will put the source to use in the neaz future, due to the <br />depletion of our other material sources. <br />c) A plan Tor resumption of mining. We plan to start mining within the next one to two <br />years. We will notify the Division of Minerals and Geology in writing when we start <br />and stop the operation. Future annual reports will indicate any activity in the azea. <br />d) The measures to be taken to comply with reclamation requirements and/or other <br />activities related to the performance standards of section 3,1 while the mine is in <br />Temporary Cessation; and <br />• Our company will conduct a minimum of two inspections of the location per yeaz. The <br />inspection will include review of the location and initiating corrective action as required <br />to keep the operation in compliance with the regulations. <br />• Inspect and maintain signs and boundary markers. <br />• No acid forming or toxic producing materials will be on this location. <br />• the Montezuma County Land Fill. <br />"AN EQUAL OPPORTUNITY EMPLOYER" <br />
